As of this week, the Alberta Condominium Dispute Resolution Tribunal (CDRT) is officially operational, offering a new avenue for condominium owners and boards in Edmonton to resolve disputes without resorting to the court system.
The CDRT is an independent, quasi-judicial body established under the Condominium Property Act. Its primary goal is to provide timely, fair, and cost-effective dispute resolution services for the condominium community. This initiative aims to alleviate the burden on the traditional court system and offer a more accessible solution for resolving conflicts.
The tribunal's jurisdiction encompasses specific matters, including:
1. Monetary sanctions imposed by a condominium corporation, including the processes involved in applying such sanctions.
2. Access to documents as stipulated under sections 43.2 and 44 of the Condominium Property Act and Part 1.6 of the Condominium Property Regulation.
3. Issues related to general meetings and special general meetings of a corporation.
To ensure accessibility and minimize costs, the CDRT primarily conducts its services online. However, offline options are available when necessary to accommodate all parties involved.
The dispute resolution process offered by the CDRT includes several stages:
1. Guided Negotiation: This initial stage involves a moderated discussion between the parties, facilitated through an online chatroom or another agreed-upon method. It encourages direct communication to resolve disputes amicably.
2. Mediation: If guided negotiation does not yield a resolution, mediation is the next step. This voluntary, informal, and confidential process involves a skilled mediator who assists the parties in understanding each other's perspectives and working toward a mutually agreeable solution.
3. Adjudication: Should both guided negotiation and mediation be unsuccessful, the CDRT provides adjudication services. This more formal proceeding involves a panel of one or more tribunal members who hear and decide the dispute. The panel's decision is legally binding and includes a comprehensive overview of the evidence, how it was weighed, the application of legislation, and the rationale behind the decision.
To support its operations, the CDRT implements a fee structure as follows:
- Application Fee: $150, which includes guided negotiation and the first four hours of mediation services.
- Additional Mediation Fees: $150 per half-day (4 hours), up to a maximum of $300 per day.
- Adjudication Fee: $350.
In cases of financial hardship, the Tribunal Chair has the discretion to reduce or waive these fees upon demonstration of need.
